Contract

The order of sale of goods by Motorbikes 4 All at an agreed price only becomes a binding contract when accepted by Motorbikes 4 All. Only once the goods are paid for in full (price as stated on the order form) can they be transferred into the possession of the customer.

Deposit

The company reserves the right to require the customer to pay a deposit on the ordering of goods. Such deposit is determined by the company at the time of order, usual requirement is £200. If the customer fails to pay for the goods/services within 7 days of notification that the goods are available for collection/delivery, the company shall be entitled to treat the contract as repudiated by the customer.

In this event, the company may retain any deposit or part thereof without prejudice to the company’s rights to recover from the customer by way of damages any loss or expense which the company may suffer or incur by reason of the customer’s default on payment.

Delivery

Motorbikes 4 All will do its utmost to ensure your goods are delivered in a timely manner, this will be within 1 month after the order date. However, Motorbikes 4 All will be under no liability of any kind for loss caused by a delayed delivery occurring outside of the control of Motorbikes 4 All. The customer will be notified when the goods are ready for collection.

The goods will only be delivered by Motorbikes 4 All if agreed by Motorbikes 4 All at the customer’s cost. Customers are required to inspect the vehicle for themselves upon delivery prior to signing the inspection/warranty agreement. If the goods are sold as a trade sale without warranty, the condition of satisfactory quality referred to above does not operate in relation to those defects.

Cancellations

No order which has been accepted by Motorbikes 4 All may be cancelled by the customer except with the agreement in writing from Motorbikes 4 All on the condition that the customer’s deposit shall be forfeit and further that the customer shall indemnify Motorbikes 4 All in full against losses (including profits), costs (including labour & servicing parts), incurred by Motorbikes 4 All as a result of cancellation. If Motorbikes 4 All agrees to refund a customer, the customer will incur a 30% restocking fee in relation to the product price.

Faults

If a customer believes that upon delivery of their goods there is a fault to the expected condition or quality of the goods, this must be reported to Motorbikes 4 All within 14 days from the date of collection of the goods or the date of refusal of delivery. If delivery is accepted and the customer does not report to Motorbikes 4 All as stated, the customer shall be deemed to have accepted the goods and deem them satisfactory.

Safety precautions and routine maintenance:

It is the sole responsibility of the customer to wear the appropriate riding gear at all times when operating the motorcycle this includes but is not limited to an approved helmet, motorcycle jacket, motorcycle gloves, motorcycle trousers, motorcycle boots.

It is also the responsibility of the customer to ensure that the motorcycle is routinely maintained and daily checks should be made before commencing any riding this includes but is not limited to oil level check, coolant level check, ensure all lights and indicators are working correctly, ensure tyres are correctly inflated, ensure chain is correctly adjusted and lubricated, ensure brake levers are correctly adjusted, ensure brake fluid level is correct, ensure all fixing and fasteners are correctly tightened, ensure that the motorcycle is not exhibiting any obvious faults such as engine light, oil light, braking light, abs lights or any other waring light.

Distance sales

If a customer exercises their right to reject within the 14-day period under the distance selling regulations act then there is a strict procedure that must be adhered to.

The customer must inform Motorbikes 4 All in writing that they are exercising their right to reject, and from that point on the customer must cease to use the vehicle in any way. The vehicle remains the sole responsibility of the customer until Motorbikes 4 All have collected the vehicle and the customer must keep the vehicle safe, secure and insured.

Any damages sustained to the vehicle while in the care of the customer will be chargeable by Motorbikes 4 All. The vehicle can only be returned to Motorbikes 4 All by way of collection arranged by Motorbikes 4 All this will be charged to the customer at a rate of £1 per mile each way from our location in Malvern to the address that the vehicle was originally delivered to.

This is to ensure that the vehicle is not damaged in transport. Motorbikes 4 All reserve the right to retain any delivery charges. Use of the vehicle will be charged to the customer at £1 per mile while the bike is in their care. Once all deductions have been agreed by Motorbikes 4 All, Motorbikes 4 All will only issue a refund once we are in possession of the vehicle and all the relevant paperwork including a full log book (V5C).

Trade sales

From time to time Motorbikes 4 All may sell a vehicle as a “Trade Sale” this is a generalised term meaning that the vehicle is sold without warranty, without inspection and is deemed as un-road worthy and will require the attention of a trained and qualified mechanic to bring the vehicle back to a road worthy condition.

All “Trade Sale” vehicles are sold as “Spares or Repair”. Motorbikes 4 All reserve the right to change the sale type of any vehicle to a “Trade Sale” by prior agreement with the customer.
